Fair Credit Reporting Act and Background Checks   Includes
information on permissible purposes of credit reports, conditions of
disclosure of consumer reports, obtaining credit reports under false
pretenses and civil liability for willful or negligent non-compliance.  

The federal Fair Credit Reporting Act (15 USC §§1681 et seq.) does not
require employers to conduct employment background checks.  But the
law sets a national standard that employers must follow in employment
screening.  State laws may give an employee more rights that the FCRA.

Oregon Laws Related to Wire Tapping  "It is illegal in Oregon to obtain
or attempt to obtain any part of a telecommunication or radio
communication to which a person is not a participant by means of any
device, unless consent is given by at least one participant.


In 1997 the state legislature adopted statutory language (ORS 181.537)
which provided DHS with broad authority to require criminal history
clearance to protect Oregon's most valuable citizens.  The consolidated
administrative rule (effective March 1, 2004) allowed the Department's
Criminal Records Unit (CRU) to implement a more comprehensive and
consistent criminal history check process.
